Terms and Conditions

1. Background
  1. By entering this competition, the Entrant(s) ("You/Your") agree to be bound by these conditions of entry.
  2. The Commonwealth of Australia, acting through the nAustralian Electoral Commission, Queen Victoria Terrace, Parkes ACT 2600. ABN: 21 133 285 851 ("the AEC")n administers the Famous People Vote Too campaign.
  3. Haystac Public Affairs Pty Ltd ("the Promoter") has been engaged by the AEC to promote the Famous People Vote Too campaign.
  4. The following organisations are major sponsors of Famous People Vote Too: ("the Sponsor").
  5. Information on how to enter, and prize details, form part of these conditions of entry.
2. Eligibility
  1. To enter you must be an Australian resident, aged over 17.
  2. Entry is not open to employees and immediate family members of the AEC, the Promoter, Sponsors and media partners identified on the website (www.famouspeoplevotetoo.com).
3. Entry Requirements
  1. Entries in each competition category are open to individuals only.
  2. Up to 5 entries per individual can be submitted. A separate entry form must be completed for each entry.
  3. Entries must have been created no earlier than 8 June 2010 and must be your own original work. All entries must be submitted in English, and must be suitable for viewing by people of all ages (i.e. G rated).
  4. Entries must be submitted via the online submission form or via email to contact@famouspeoplevotetoo.com.
  5. Entries close 5.00pm AEST 3 August 2010 .
  6. Entries must be uploaded onto www.youtube.com in either WMV, MPEG, AVI, MOV, MP4, FLV, MKV format
  7. Entrants must submit a valid link to the YouTube video via the website entry form. Videos will be displayed on the website within 24 hours of being received.
  8. Video entries are to be no longer than 5 minutes in length and no larger than 10mb in size.
  9. Photograph entries should be submitted via flickr as per the terms and conditions of this website.
  10. To be eligible for the competition, the subject of the video should discuss the importance of enrolling to vote and voting correctly. Your video should also include the poster and/or t-shirt*, available via the Famous People Vote Too website. *T-shirts are only available while stocks last.
  11. Where your entry identifies a person(s) other than yourself, your entry must be accompanied with a personal information consent form . A consent form must be completed by every person identified in your entry and who is not an entrant. If consent for each person is not provided, the entry will not be accepted for privacy reasons.
4. Prizes and Awards
  1. Prizes are awarded to entrants who exercise skill in addressing the competition criteria. The competition does not involve chance.
  2. The AEC will select one winning entry per week of the competition duration (June 8 August 3, 2010) based on the criteria below:
    • How well the videos subject conveys the key messages around the importance of voting
    • The creativity of the video.
  3. The judges decision is final and no correspondence will be entered into.
  4. Unless otherwise stated, prize/s can be redeemed by the individual responsible for submitting the video only.
  5. The weekly prize for the competition is an iPod touch 8GB (part number MC086ZP/A) valued at $233.89 each.
5. Entrants Rights and Obligations
  1. By entering into this competition, you retain ownership of intellectual property rights in your Entry. You are free to continue to use your entry for any purpose.
  2. By entering into this competition you (the Entrant) agree to grant to the AEC, and to Sponsors and Promoters of the NYW National Talent Competition, a permanent, irrevocable, free, world wide, non-exclusive licence (including right sublicense) to use, reproduce, adapt and exploit the intellectual property rights in entry/entries of categories that they are sponsoring or required to promote, for the purpose of promoting and publicising the Famous People Vote Too campaign, or for any other purpose, with or without attribution of authorship, and including by supplementing the entry with any other material or using it in a context which is different to that envisaged by you.
  3. Completion and submission of an entry will be deemed as acceptance by the entrant to allow the Promoter to disclose their name and postal address to the Promoter or sponsors, in the event that they are a winner, to enable the Sponsors to send the individual their prize.
  4. Entrants and winners are expected to cooperate with all reasonable requests by the AEC or the Promoter to participate in relevant media interviews.
6. AEC & Promoters Rights and Obligations
  1. The AEC and the Promoter reserve the right to:
    • verify the validity of entries and entrants including an entrants identity, age and place of residence; and/or
    • disqualify any entrant who submits an entry that is, in its reasonable opinion, not in accordance with these conditions of entry.
  2. Neither the AEC nor the Promoter accept any responsibility for late, lost, misdirected, incomplete or incorrect entries.
  3. Entries that are deemed indecent, defamatory or inappropriate for public display by the AEC will not be accepted.
  4. Neither the AEC nor the Promoter are liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained during the course of developing the entry or during the assignment of the prize except for any liability which cannot be excluded by law.
  5. Neither the AEC nor the Promoter accepts any responsibility for prizes not claimed before 3 August 2010.
  6. The AEC and the Promoter reserve the right to grant a sublicense to third parties to use Your Entry for the purpose of promoting and publicising the Famous People Vote Toocampaign, or for any other purpose.
  7. The AEC or the Promoter may disclose Your personal information and other persons personal information contained in Your Entry to other Commonwealth agencies and parties engaged for sponsorship, promotional and management services the purpose of promoting and publicising the Famous People Vote Toocampaign.
  8. The Promoter will endeavour to obtain your consent before using your entries for publicity purposes.
  9. The AEC and Promoter will act in good faith when using the entries, and will endeavour to attribute authorship of entries that are used for publicity purposes.
7. Sponsors Obligations
  1. Sponsors reserve the right to use your entry for the purpose of promoting and publicising their involvement, or for any other purpose.
  2. Sponsors reserve the right to use your personal information for promotional purposes and for the purpose of delivering prizes and awards.
  3. Sponsors will endeavour to obtain your consent before using your entries for publicity purposes.
  4. Sponsors will act in good faith when using entries and will endeavour to attribute authorship of entries that are used for publicity purposes
8. Promoters Rights and Obligations
  1. The Promoter reserves the right to use your entry for the purpose of promoting and publicising the Famous People Vote Too campaign, or for any other purpose.
  2. The Promoter reserves the right to use your personal information for promotional purposes and for the purpose of delivering prizes and awards,
  3. The Promoter will endeavour to obtain your consent before using your entries for publicity purposes.
  4. The Promoter will act in good faith when using entries and will endeavour to attribute authorship of entries that are used for publicity purposes.
  5. The Promoter reserves the right to contact You if You are a winner of the one categories.
  6. The Promoter is obligated to send Your awards if You are a winner of the one categories.
9. Privacy
  1. The AEC and Promoter manages information collected from entrants in accordance with the Privacy Act 1988.
  2. The AEC and Promoter may use and publish Your name, State/Territory, photograph, music, writing, videos or designs for promotional purposes relating to the Famous People Vote Toocampaign.
  3. The AEC and Promoter may also broadcast Your entry in its entirety
  4. The AEC may also provide Your name, State/Territory to AEC divisional offices for the purpose of distributing enrolment forms, if requested to do so by You
  5. The AEC and Promoter may also provide Your name, State/Territory and entry to the Sponsors and media outlets for promotional purposes relating to the Famous People Vote Toocampaign, and for the purpose of delivering prizes and awards.
  6. Your personal information will not be used for any other purpose, added to any mailing list or disclosed to any person or organisation without your consent unless such disclosure is permitted pursuant to the Privacy Act 1988 or otherwise specified in the Conditions of Entry.
